KOBIZE report - who is subject to it and what is the reporting like?

KOBiZE report

The KOBiZE report is a set of information used to calculate the environmental fee for gas and dust emissions into the air. The report is submitted electronically through an account in the so-called National Database. KOBiZE.
The KOBiZE report for 2023 must be submitted by February 29, 2024. (Article 7(1) of the Act on the system for managing emissions of greenhouse gases and other substances. The entity using the environment whose activities cause emissions shall prepare and enter it into the National Database within by the end of February each year, (…), regarding the previous calendar year.)

KOBiZE registration

You must register an account on the national database website and follow the instructions for registerion form.
Submitting the form is possible after confirming your identity by the National Electronic Identification Node (KWIE). This can be done using electronic banking, trusted profile, mObywatel application, e-ID or USE eID.
The entire process of creating an account and registering is very intuitive. In case of problems, you can use the instructional documents available on the portal's pages.
The entire registration process may take up to 21 days.
One of the documents that must be provided with the registration form is a power of attorney. A power of attorney template can be downloaded from our website. They should bear a qualified electronic signature, a trusted signature or a personal signature.

Who is obliged to submit a report?

Every entity using the environment whose activities cause emissions is subject to the obligation to submit a KOBiZE report. If, as an entity using the environment (e.g. an entrepreneur), you have company cars that you use, you cause emissions into the air - so you should prepare and submit such a report.
The definition of an entity using the environment is included in Art. 3 points 20 of the Environmental Protection Law. In short, it can be written that it is an entrepreneur, a person conducting production activities in agriculture in the field of agricultural crops, animal husbandry, horticulture, vegetable growing, forestry and inland fishing. Organizational units that are not entrepreneurs (e.g. school, hospital) and natural persons who are not entities and use the environment to the extent that use requires a permit are also entities that use the environment.

Emission factors

To calculate emissions for the purposes of KOBiZE reporting, you will need emission factors, which are the amount of pollutants emitted by a given fuel consumed by the installation.
It is best to look for emission indicators on the KOBiZE website in the Instructions/Auxiliary Materials tab. 

Example:

The entity using the environment operates a sprinkler system. In 2022, 480 liters of diesel were used. How much dust is emitted into the air?
Assumptions:
Fuel – 480 l of diesel –> which gives 0.403 Mg in terms of mass
The calorific value of the fuel is 45,000 kJ/kg

Calculations of the amount of dust emitted by the sprinkler system
0.403 Mg * 4300 kJ/kg * 2 g/GJ / 1000000 = 0.34 kg

Other important dates

- report on waste generated to the Marshal's Office, the so-called BDO report - by March 15
- fees for the use of the environment to the Marshal's Office - by March 31 (collective summary of information on the scope of use of the environment and the amount of fees due)

Legal basis as of 18.01.2024 r.
The Act of July 17, 2009 on the system for managing emissions of greenhouse gases and other substances introduced the obligation for entities using the environment to submit annual reports on the emission levels of greenhouse gases and other substances released into the air. Pursuant to the above Pursuant to the Act, these data are collected by the National Center for Emission Balancing and Management in the National Database on emissions of greenhouse gases and other substances.
The entity using the environment, whose activities cause emissions, prepares and enters into the National Database, by the end of February each year, a report containing information (...) regarding the previous calendar year (Article 7 of the above-mentioned Act).

Pursuant to Art. 7 above Act:
2. If the obligation to prepare and enter a report is related to the operation of the installation, the entity obliged to prepare
and entering the report is the installation operator.
operator of an installation means an entity authorized on the basis of a specific legal title to take possession of the installation in order to operate it in accordance with environmental protection requirements, on the terms specified in the Act (Article 3, point 31 of the Environmental Protection Law).
2a. If during a calendar year the rights and obligations of an entity using the environment are taken over by another entity, the obligation to prepare and submit a report for that year rests with that entity, subject to paragraph. 2b.
2b. If the new entity using the environment is not the legal successor of the previous entity, each of them prepares and enters a report for the period in which it conducted activities covered by the obligation to prepare a report.
3. Emission volumes included in the report referred to in section 1, is determined on the basis of measurements carried out or on the basis of information on the production volume, consumption of fuels or raw materials and the corresponding emission factors.
