What is the BDO register?

It is a register of entities introducing products, products in packaging and managing waste. It has been operating since January 24, 2018. It was created to organize paper-based documentation in favor of electronic implementation of registration, record-keeping and reporting obligations. 

Reporting 2024

Pursuant to Art. 75, section 1, point 1 and art. 237aa of the Waste Act - an annual report on waste generated and waste management is prepared by the producer who is obliged to keep waste records.

Entities obliged to prepare the reports referred to in Art. 73, art. 74a and art. 75 of the Waste Act, submit them by March 15 for the previous calendar year to the voivodeship marshal competent for the place of waste production, collection or processing - in the case of a report on waste generated and waste management.
Pursuant to Art. 180a of the Waste Act, whoever, contrary to the obligation, does not submit a report, is subject to a fine.

BDO - what can you get a fine for??

For not entering data into BDO

Pursuant to Art. 180 of the Waste Act: Whoever, contrary to the obligation, does not enter or does not enter into BDO on time the information contained in waste records documents, shall be subject to a fine of PLN 1,000 - 1,000,000.

For failure to submit an annual report on waste generated and methods of waste management.

Pursuant to Art. 180a of the Waste Act, whoever, contrary to the obligation, does not submit a report, is subject to a fine.

For waste management inconsistent with the information reported to the register.

Pursuant to Art. 178 of the Waste Act, anyone who manages waste contrary to the information reported in the register is subject to a fine.

For missing an entry or changing an entry.

Pursuant to Art. 179 of the Waste Act, whoever does not submit an application for entry in the register, for a change in the entry in the register or for deletion from the register, or who submits an application that is inconsistent with the actual situation, shall be subject to the penalty of arrest or a fine.

For running a business without an entry

Pursuant to Art. 194 points Waste Act, who conducts activities in the scope referred to in Art. 50 section 1 without the required entry in the register is subject to an administrative fine of PLN 1,000 - 1,000,000.
